In Error to the District Court of the United States for the Southern District of Mississippi; Henry C. Niles, Judge. Action by C. A. Dee, administrator of the estate of Percy R. Johnson, deceased, against the Jackson Right & Traction Company. Judgment for plaintiff, and defendant brings error.

EOS'J'ER, District Judge.

This is an action for damages for the death of defendant in error’s intestate. The case went to the jury, and resulted in a verdict for defendant in error in the sum of $10,000. Error is assigned to the refusal of the District Court to direct a verdict in favor of plaintiff in error, and to the overruling of a motion for a new trial. No other errors are assigned.

The deceased was killed in'a collision between a Eord automobile which he was driving and a street car belonging to the plaintiff in error. The record contains the testimony of at least five witnesses tending…
