dissenting. — In most of the cases in which there has been a difference of opinion in this court, that difference has arisen from the different view of the facts taken by different Judges. I shall in this case state the facts which appear on this record, in the order of time in which they occurred. It was agreed, as well as proved, that the land in question was the property of William Hamilton, though he had taken a warrant in the name of Daniel, his oldest son; that William lived and died, some time before 1787, in possession; he died intestate, leaving three sons and five daughters, viz;…
