OVERTON, J.

Harry Aston and Philip Bloomfield were -arrested by the police of the city of New Orleans for violating certain ordinances of that city, and were incarcerated in the First Precinct police station.

On the day following their arrest, Richard A. Dowling, judge of division 0 of the criminal district court for the parish of Orleans, issued an order for their release on parole, which order Ray and the police department refused to recognize.
