HENDERSON, Judge.
Appellant was convicted of murder in the second degree, and his punishment assessed at seven years confinement in the penitentiary, and brings the case here on appeal.
The facts summarized are to the effect that Jim Holt, the father of appellant, owned some kind of a wagon-yard, or a place where horses were kept, and on the occasion of the homicide he, with deceased E. B. Street, and several other companions, were at said Holt’s place of business drinking and carousing. Late in the evening appellant went home, leaving his father there.
