Appeal from an order made at a Special Term, directing the clerk of Niagara county to tax and adjust the defendant’s costs and ■disbursements in this action. This action was brought by the plaintiffs to recover certain •chattels which they alleged belonged to them and which the defendant wrongfully took and detained, the value of the property so •claimed by the plaintiffs amounting to the sum of $852.38, and eonsisting of a considerable number of articles of ready-made clothing. “ Daniels, J.:
“ Upon the trial of this action the plaintiffs recovered a verdict for a portion of the goods, for the possession of which a suit was prosecuted. The amount recovered by them exceeded in value the sum of fifty dollars ; for the residue the defendant recovered a verdict. The value of the goods recovered by him also exceeded the sum of fifty dollars; and also the value of those recovered by the plaintiffs.
