J. E. Mott was convicted of the crime of permitting a game of stud-horse poker to be played for money, checks, etc., in his place of business at Billings, on March 24, 1924. His appeal is from the judgment and from an order overruling his motion for a new trial.
Appellant has made twelve assignments of error: Nos. 1, 2, 3 and 4 deal with a series of questions on cross-examination, all referring to the same subject matter*, and will be treated jointly; No. 5, with impeachment testimony; and No. 6, with the admission of certain evidence in rebuttal.
