This matter is before the court upon United States Magistrate Judge Joseph McCrorey’s recommendation that Plaintiff Christopher Odom’s (“Plaintiff’ or “Odom”) suit brought pursuant to 42 U.S.C. § 1983 be dismissed as to Defendant S.C.D.C. Insurance Policy Holder without service of process and without prejudice pursuant to Rule 41 of the Federal Rules of Civil Procedure.
