This case involves the question as to whether Elizabeth Gaston, a child born October 10, 1956, was a dependent and neglected child when proceedings were filed November 2, 1961, to have her so declared. Trial from which this judgment resulted was to a jury and in response to issues submitted by the court the jury found she was a dependent and neglected child; that appellants, who are the uncle and aunt of *708Elizabeth, were fit and proper persons to have custody of her; that appellees, the father and mother of Elizabeth, were not fit and proper persons to have custody of her;…
