SMS Assist L.L.C. (“SMS”) is a company that provides maintenance services to corporate clients by contracting with, and supervising, third parties who perform those services. In October 2008, Family Dollar Stores, Inc. (“Family Dollar”) hired SMS to manage snow removal and de-icing services (“snow removal services”) at Family Dollar stores across the nation during the 2008-2009 snow season.
