PRAY, District Judge.

The above-entitled suit is for an accounting and for the interpretation of certain provisions relating to expense under an agreement executed October 28th, 1922, between Homestake Exploration Corporation, hereinafter referred to as Homestake, as party of the first part, and the above-named plaintiffs, as parties of the second part. Homestake was succeeded by Texas Pacific Coal & Oil Company, hereinafter called Texas Company, by assignment of said agreement dated November 28th, 1927.
