This is a chancery suit depending in the Circuit Court of Giles County, Virginia, which arose out of the judicial sale of the lands of the appellant, J. J. Cole, to the appellee, M. P. Farrier, by the court’s commissioner.

The case, which is a general creditors’ suit, was instituted in January, 1921, by the Graham Grocery Company, a lien creditor of the said Cole, by reason of its judgment against him which was obtained in 1919, seeking to subject his real estate, consisting of lands and timber rights, thereto.
