Plaintiff, as surviving widow of Joseph H. Payne, deceased, brings this action to recover damages on account of the death of her said husband by reason of the alleged negligence of defendant, W.D. Reed. The death of Joseph H. Payne is alleged to have been caused by his being struck and fatally injured by an automobile being driven by defendant. The defendant is charged with negligence in driving and operating the automobile in question. The case was tried to a jury, resulting in a verdict for defendant.
