On July 29, 1914, defendant Thomas Hogan executed and delivered to James P. Owen his bond, whereby he bound himself,, his heirs, executors and administrators in the sum of $144,000, upon condition that said bond should be void if he, his heirs, executors or administrators should pay to the said James P. Owen the sum of $72,000 on the 1st day of August, 1929, with interest thereon at five per cent per annum.
