This is an interlocutory appeal of a denial of The University of Texas at El Paso’s (“UTEP”) plea to the jurisdiction. In Issue One, UTEP contends Appellee, Amalia Muro’s premises liability claim does not come within the Texas Tort Claims Act’s waiver of sovereign immunity because: (1) Ms. Muro failed to show the university’s actual knowledge of the condition which allegedly caused her injury; (2) the condition did not pose an unreasonable risk of harm; and (3) the condition was easily perceptible, and therefore, cannot be the basis of a duty.
