STATEMENT OF THE CASE:

Augustus Flowers was charged by grand jury indictment on March 26, 1992, with seven counts of distribution of heroin, a violation of LSA-R.S. 40:966, and with one count of possession with intent to distribute heroin, also a violation of R.S. 40:966. At his arraignment on April 3, 1992, he pled not guilty. The trial court found probable cause and denied the motion to suppress the evidence on May 15, 1992.
