This is an action for conversion instituted by the mortgagor as against his mortgagee for the wrongful seizure of a chattel, to wit, an automobile. This is the second appearance of this suit in this court. The facts in the previous action are practically the same as in this error proceeding, the parties, however, appearing in reverse order. The pertinent facts are to be found fully set forth in the case of Bear v. Colonial Finance Co., 42 Ohio App., 482, 182 N. E., 521, and need not here be repeated.
