The petitioner Logan was duly appointed a police officer of the city of Lawrence in the year 1889, and ever since has held that position. In January, 1906, he was also duly appointed by the mayor and aldermen to be an assistant marshal of police. He was reappointed in January, 1907, and continued to serve in that capacity, although no specific appointment was made in January, 1908, until January 4, 1909, when he was formally removed from office by the mayor and aldermen, and *508the respondent Yose was appointed in his place.
