The information upon which appellant was convicted in the superior court is as follows:

“That on, to-wit: the 19th day of December, A. D. 1894, the said C. 0. Downing was the duly elected, qualified and acting county clerk in and for the county of Spokane and state of Washington, and the ex-officio clerk of the superior court in and for said county and- state, and, as such county clerk and ex-officio clerk of the superior court was not allowed by law to be paid or to receive any money, fees or compensation for his services as such county clerk and ex-officio clerk of the superior court, except…
