Appeal from a judgment of the Wayne County Court (John B. Nesbitt, J), rendered August 19, 2003. The judgment convicted defendant, upon his plea of guilty, of robbery in the first degree and burglary in the first degree.

It is hereby ordered that the judgment so appealed from be and the same hereby is unanimously reversed on the law, the *1053plea is vacated, that part of the motion seeking to suppress the statements is granted in its entirety, and the matter is remitted to Wayne County Court for further proceedings on the indictment.
