In an action for a judgment declaring the parties’ rights under a lease, the defendants appeal, as limited by their brief, from so much of an order of the Supreme Court, Nassau County (Segal J.), dated August 2, 1994, as, upon reargument, adhered to the prior determination which granted the branches of the plaintiffs motion which were (1) to enjoin the defendants from prosecuting a summary nonpayment proceeding in the District Court, Nassau County, and (2) for a Yellowstone injunction, and directed the plaintiff to post an undertaking in the sum of only $100,000.
