This was an action for taking and carrying away the goods of the plaintiffs, brought against the defendant, who was sheriff of Mercer county.
John Sheerer being indebted to sundry persons, on the 11th of December 1832, executed an assignment to the plaintiffs, John Fisher, Esq., Robert M’Farlane, and David Courtney, Jun., of all his property, real and personal, for the benefit of his creditors; a store of goods was specified as part of this property.
