*1150Appeal from an order of the Supreme Court, Chautauqua County (Paula L. Feroleto, J.), entered September 22, 2005 in a personal injury action. The order denied the motion of defendant NVR, Inc., doing business as Ryan Homes of New York, for summary judgment dismissing the amended complaint and cross claims against it.
It is hereby ordered that the order so appealed from be and the same hereby is unanimously reversed on the law without costs, the motion is granted and the amended complaint and cross claims against defendant NVR, Inc., doing business as Ryan Homes of New York, are dismissed.
