The Court of Appeals desire instruction from the Supreme Court upon the following questions:

*714“1. Will^a writ of error lie from the city court of Springfield to the Court of Appeals of Georgia?
“2. Is the judge of the city court of Springfield without power or authority to hear and determine a motion for new trial, or to grant a new trial, for the reason that the city court of Springfield is not within the purview of the constitution of Georgia, relating to the grant of new trials?”

The proper answer to the two questions certified depends upon the court’s construction of that part of sections 34…
