Judgment of the Supreme Court, New York County (Frederic Berman, J.), rendered May 6, 1986, after a jury trial, which convicted defendant Kelmy Rodriguez of manslaughter in the first degree (Penal Law § 125.20 [1]) and criminal possession of a weapon in the second degree (Penal Law § 265.03), and which sentenced him to concurrent indeterminate terms of imprisonment of from 8V3 to 25 years for manslaughter and 5 to 15 years for weapon possession, unanimously modified on the law, to the extent of reducing the conviction of manslaughter in the first degree to manslaughter in the second degree…
