KRUEGER, Judge.

The conviction is for theft of cattle; the punishment as sessed is confinement in the State penitentiary for a term of two years.

In order to intelligently discuss the question presented for review, we deem it proper to briefly state the testimony as reflected by the record.

About the middle of the month of December, 1938, Haywood Wesley, an old negro, who lived on a farm in Panola County, missed two of his cows from the range where they were accustomed to run.
