On the 28th day of January, 1939, the plaintiff recovered a judgment against the defendants-respondents for $1,288.66. Thereafter the defendants appealed from the judgment of the Supreme Court to the Appellate Division, Third Department, and in order to obtain a stay of execution there was delivered to the county clerk, in lieu of bond, as provided by sections 564 and 615 of the Civil Practice Act, the sum of $1,288.66 to be held pending the outcome of the appeal.
