— In a proceeding pursuant to CPLR article 78, the Commissioner of the New York State Office of Mental Retardation and Developmental Disabilities appeals from a judgment of the Supreme Court, Westchester County, dated October 31, 1980, which granted the petition and annulled a determination of the commissioner approving the petitioner town as an area in which a community residence for mentally disabled persons might be established.
