CLARK. J.

The plaintiffs in error instituted this suit in the district court of Murray county against the defendant in error. U- S! Joines, for the recovery of the allotment of Emma Pattersdn, deceased. The case was tried in the lower court upon an agreed statement of facts.

The facts necessary for the determination of this cause are as follows: Emma Patterson died intestate on the 14th day of March, 1906, and the lands involved herein were allotted to her after her death. She was survived by her husband, W. M. Patterson, and the following children: Dorotb A. McFarland, nee Patterson, 26 years…
