OPINION
JACK SMITH, Justice.
This is an appeal from a summary judgment denying appellant relief in a bill of review proceeding which challenged an order modifying conservatorship on the basis of extrinsic fraud.
Appellant and appellee were divorced June 9, 1976, and appellant was named managing conservator of the couple’s minor child, Branden Lark (Brandi) Mott. In April 1980, appellee returned to the United States after working for approximately nine months in Saudi Arabia. Upon his return, he purchased a home in Katy, Texas, and in May 1980, Brandi moved to Katy to reside with her father.…
