This is an appeal by C. H. Foot, as executor of the estate of Eugene E. Kelley from a part of an order settling his report and account of the administration of the estate.

It appears that Eugene E. Kelley died testate. By his will he devised a life estate in certain real property- used as the home, to his wife, Helen F. Kelley, and bequeathed to her an annuity of $100 per month during her life. The residue of the property was devised and bequeathed to C. H.
