dissents, and votes to affirm the order insofar as appealed from, with the following memorandum in which Leventhal, J., concurs: The defendant’s parents owned a house on Staten Island for many years. The defendant lived with her parents in the premises from approximately 1962 through 1977. The defendant’s father died in 1980. The defendant’s mother continued to reside in the premises. In 1993, title to the house was conveyed to the defendant, subject to a life estate held by her mother. The defendant’s mother died in September 1997.
