The issues and testimony present the question as to whether there is a highway running from the northwest corner of defendant’s premises at East State street down a dugway road, crossing the lot line between lot 3 and lot 31, and thence east of defendant’s mill building to Dyke’s creek, crossing the creek and leading southerly to Broad and Dyke streets, in the village of Wellsville. That portion of the alleged highway from the north bank of Dyke’s creek to East State street runs wholly through the premises of the defendant.
