Browning were jointly indicted in tbe Circuit Court of Sunflower county, for tbe murder of one Jobn~Wl Neal. Upon tbe application of tbe prisoners, tbe Tenue was changed to tbe county of Holmes.

At tbe November term, A. D. 1854, of tbe Circuit Court of Holmes county, tbe defendant, Gaston E. Browning, was tried, tbe court having allowed tbe prisoners to sever in tbe trial. Gaston E. John D. Browning and Gaston E. Browning, were jointly indicted in the Circuit Court of Sunflower county, for the murder of John Neal. Upon the application of counsel of prisoners, the venue was changed to Holmes county, in which the trial took place. The parties charged were tried separately; and Gaston E. Browning, whose case is now before us, was convicted of murder and sentenced accordingly.
