As has been seen, on November 9, 1892, Asahel Gage filed a plea, in which he set up and relied upon a tax title under a sale of the undivided half of the lot in 1882 for the taxes of 1881. Upon the filing of this plea the complainant, Jacobs, by leave of the court, amended his bill, setting up facts to impeach the tax title, but plaintiff in error, Henry Harms, was not ruled to answer the amended bill, and never, in fact, answered it, and it is claimed in the argument that the court erred in rendering a decree without first requiring an answer from Harms.
