The plaintiff leased to the defendant a certain building “ for the term of one year with privilege of two years additional from the first day of December, A. D. 1892, at a rent of two thousand dollars per year to be paid in equal monthly payments .... in advance.” The lessee covenanted that they “ at the termination of said term, will deliver up said premises in as good condition, order and repair as the same now are in,” etc. The lease contained this further provision: “And it is hereby mutually agreed that either party hereto may determine this lease at the end of said…
