Lawrence was convicted of violating the automobile law in a justice of the peace court and on appeal to the circuit court was acquitted and the state appeals. The appellee was arrested upon a warrant made by a constable of Hinds county, charging a violation of chapter 108 of the Laws of 1912. This is an appeal by the state from an acquittal of ap-pellee in the court below for the alleged violation of ‘‘an act to provide for the numbering and registration of au*73tomobiles owned and operated in the state of Mississippi, and to provide for the payment of a registration fee, and being chapter 108 of the Laws of 1912. ’ ’ The canse was submitted to the court upon an agreed statement of facts, without a jury, and the statute was held to be unconstitutional and void.
