This is a suit for the sum of $103.31, covering property damage to a Pord truck, destruction of milk bottles, and tbe loss of a certain quantity of milk, said to have resulted from a collision between defendant’s street car and plaintiff’s truck at tbe intersection of Chippewa and Soraparu streets, this city, on May 22, 1931, about 2 o’clock a. m.

Tbe charges of negligence against tbe defendant are tbat the motorman of tbe street car was operating tbe car at an excessive rate of speed and tbat he failed to observe the truck which bad entered tbe intersection first and, under the provisions of…
