Appeal from Lmn Distriot Gowt. — W. N. Treichjder, Judge. The plaintiff church filed a claim against the estate oí John B. Leigh, to recover the amount of a fund alleged to have been held in trust for its benefit by the said Leigh in his lifetime. The trial court found for the plaintiff, and the defendant appeals. The material facts are stated in the opinion.

The plaintiff church is, and for many years has been, an organized society for religious work and worship in the town of Mt. Yernon. Among its adherents and *933supporters for a considerable period of time was the deceased, John B. Leigh. He was a man of some means, and manifested a spirit of liberality in sustaining the church of his choice. Some years prior to the transaction now in question, one Armstrong was also a leading member and elder of the local church. A son of this person, J. H.
