This is a proceeding under article 78 of the Civil Practice Act, in which the petitioner seeks, in effect, a declaration, among other things, that he is a regular member of the English Department in the day-session faculty of the College of Liberal Arts and Sciences- of City College, with full tenure rights as of May 20, 1931. Respondents have filed an amended answer to the petition, containing various defenses.
