Appeal by the plaintiff, Solomon Posnick, from a judgment of the Supreme Court in favor of the defendant, entered in the office of the clerk of the county of Bronx on the 13th day of June, 1917, upon the verdict of a jury, and also from an order entered in said clerk’s office on the 20th day of June, 1917, denying plaintiff’s motion for a new trial made upon the minutes.

Shearn, J.:

The plaintiff appeals from a judgment entered upon the verdict of a jury in an action brought to recover damages for personal injuries sustained as a result of the negligence of the defendants. The respondent was the owner of buildings in the course of erection and the plaintiff was a carpenter on the job, who was in the employment of thé defendant Schwartz, a contractor for the carpenter work.
