The plaintiff in error, by this proceeding, seeks to obtain a peremptory mandamus against the defendants in error, compelling them to restore him to his position as a member of the municipal police force.

It appears from the alternative writ, which was allowed by the Supreme Court, and from the return thereto that, by the charter of the city of Bayonne, granted by the legislature in 1869, the board of councilmen of the city were authorized to establish a police force, and to regulate and define the manner of the appointment and…
