Appeal by the defendant, The American Law Book Company, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of Hew York on the 11th day of May, 1905, tipon the decision of the court, rendered after a trial at the Hew York Special Term, granting an injunction.

The defendant is engaged in the compilation and publication of „ the “ Cyclopedia of Law and Procedure,’-’ and the plaintiff entered into a contract with it whereby he agreed, for one year at five dollars and sixty cents per page, to write and prepare original articles and treatises, or parts of articles and treatises, on subjects and topics of the law selected and assigned to him by the defendant.
