This appeal is prosecuted from a judgment of the district court refusing to probate a certain instrument in writing purporting to be the last will a'nd testament of Miss Eunice Hopkins Smith, deceased, tendered for probate by appellant Mrs. R. E. Rateliffe, joined pro forma by her husband, R. E. Rateliffe, and probating an instrument purporting to be the last will and testament of said decedent, tendered for probate by appellee Seaboard National Bank of Npw York.
