CASELLAS, District Judge.

Before the Court is Defendant Cesár Rey’s motion for summary judgment (Dockets ##46 & 48). Defendant contends that Plaintiffs have failed to effectively set forth a claim actionable under 42 U.S.C. § 1983 and that, in the alternative, he is shielded form Plaintiffs’ claim pursuant to qualified immunity. Plaintiffs have timely opposed Defendant’s motion (Docket # 53) and, in turn, Defendant has filed a reply to the opposition (Docket # 59).
