Plaintiffs, on August 30, 1946, commenced a suit to rescind a contract to purchase thirteen acres of land lying adjacent to what is commonly known as the “Columbia Slough” in Multnomah county, Oregon. From a decree dismissing the suit, the plaintiffs have appealed.

The plaintiffs, Hans Walters and his brother Arthur, for several years were engaged in the business of building small and medium-sized boats. During World War II the plaintiffs ceased building operations; but when it was over, they undertook to find a more suitable site for conducting their business. On the 5th day of April, 1946,…
