In a negligence action to recover damages for personal injuries, defendant Harry Molberger appeals from an interlocutory judgment of the Supreme Court, Kings County, entered June 17, 1971, against him and in favor of plaintiff, upon a jury verdict after a trial on the issues of liability only. Interlocutory judgment reversed, on the law and the facts, without costs, and complaint dismissed, without costs.
