This common law negligence dispute arises out of an accident that occurred on a construction site in Sterling, Virginia. Appellant Carl Tuel (“Tuel”) brought suit against Appellee Hertz Equipment Rental Corporation (“Hertz”) alleging Hertz owed him, as a foreseeable third party, a duty of reasonable care in performing maintenance on its leased construction equipment. Tuel alleged Hertz failed to exercise reasonable care, and, as a result, Hertz’s negligence caused Tuel physical injury…
