In 2006, a Plymouth County jury found the defendant guilty of murder in the first degree by reason of extreme atrocity or cruelty when he ran over his former wife with his vehicle. The defendant appealed. Represented by new counsel, the defendant filed a motion for a new trial alleging constitutionally ineffective assistance of trial counsel. The trial judge denied the motion without a hearing. The defendant appealed.
