Affirming.

The appellee, Williamson and Pond Creek Railroad Company, in the year 1912 constructed a line of railroad from Williamson, West Virginia, across Tng river and np Pond creek in Pike county, Kentucky.

The appellant, John W. Taylor, owned a tract of land located on each side of Pond creek, and the railroad company, not being able to agree with him as to the compensation to be paid to him for right of way through his lands, filed a suit in the Pike county court to condemn a right of way varying in width from 60 to 120 feet.
