This is an action of trespass to try title, brought by 'O. O. Thomas, ap-pellee”, against T. C. and C. T. Mitchell, appellants, in the district court of Presidio county, Tex., on May 5, 1913, in which appellee sought to recover of appellants title and possession of public free school section No. 20 in block No. 1 in that county. Appellants’ answer denied the trespasses, injuries, and wrongs complained of, and set up a cross-action against appellee, claiming title in themselves to said section. Appellee entered a plea of not guilty to said cross-action and further pleaded his title specially.…
